If that photo is in the UK it's not. If you're having a meal in a licensed resturaunt it's legal to have an alcoholic drink with your meal from the age of fourteen, provided it's bought by someone over eighteen.

I'm fairly certain it's moot anyway, as to me it looks as if she's posing with someone elses drink.
